COMMUNAL VIOLENCE BILL 2011 – MALAFIDE IN INTENT, MISCHIEVOUS IN CONTENT, DIABOLICAL IN DESIGN AND CALCULATED TO DESTROY HINDUS IN INDIA

The bill titled”Prevention of Communal and Targeted Violence Bill – 2011” has been drafted under the leadership of UPA Chairperson Sonia Gandhi.  It will soon be tabled in Parliament for approval.

The bill divides Indian society in two parts: “Group” (minority community comprised of Christians and Muslims) and “Others” (majority community, meaning Hindus).  This bill assumes that “Others”, the majority community of India (Hindus) are habitual perpetrators of violence and the ”Group” (Muslims and Christians) are the victims. 

On the contrary, study after study has proven that Muslims have instigated many of the communal violence incidents in India.  Several of these studies have been by independent and renowned juridical authorities of unimpeachable integrity.  To cite an instance, Justice Tewatia’s “indisputable” report clearly states the attacks on Sabarmati Express at Godhra station on February 27, 2002 were pre-planned by a Muslim mob in which 58 Hindu women and children were roasted alive.  (http://www.jaia-bharati.org/nicole-elfi/ni-godhra-ang.htm).

This bill has been drafted by National Advisory Council (NAC).  The Advisory committee is a nominated body and has no constitutional status.  The stated purpose of the Bill is to address the question of communal violence in the country but the extremely insidious agenda is to communalize Indian polity, create hatred against Hindus, destroy communal harmony, demonize Hindus and convert Hindus either to Christianity or Islam.

This bill seeks to perpetuate a fraud on the majority Hindu community of India.  The bill’s target is implicit and sub rosa the Hindu community of India.  The bill subliminally propagates abhorrence against Hindus.

Amongst the exceptionally biased and one-sided provisions of the bill are:
  • If a case is registered against a Hindu, he has to prove his innocence.
  • This law is applicable only when the victim is the “Group” that is, a Muslim or a Christian.
  • During the trial, the court may issue orders to attach the property of the accused Hindu.
  • The victim will be granted financial compensation within 30 days.
  • If a Hindu loses property, is humiliated or boycotted, this law would not apply.
  • If any Hindu publishes, communicates, disseminates, broadcasts, advertises by words, either spoken or written, news about communal violence he would be prosecuted for hate propaganda.
  • Under this bill, if a Muslim or a Christian complains against any Hindu leader or organization that his/her feelings have been offended, that person/organization would be hauled up.
  • Hindus would be prosecuted by “Communal Harmony Authority” to be set up at the state and central levels with seven members each, of which four including chairman and deputy chairman should be from the minority communities.
  • All the crimes mentioned under this law are non-bailable.

High Court Advocate, P.P. Hegde has termed the bill as “dreadful”. Mr. Hegde has compared this bill to the imposition of jaziya (tax on infidels) on Hindus and Sikhs during Islamic rule in India. BJP has described it as “dangerous”. Jaya Lalitha, Chief Minister of Tamil Nadu finds this bill as “Fascist”. Mamta Banerjee, Chief Minister of West Bengal; Mayawati, Chief Minister of U.P.; and several other Chief Ministers have vehemently criticized it. None of the Opposition Parties or Hindu leaders have been consulted in this regard.

The names of the principal members of the drafting and advisory committee are as under:
Najmi Waziri, P.I.Jose, Teesta Setalvad, Farah Naqvi, Abusaleh Shariff, Asgar Ali Engineer, John Dayal, Justice Hosbet Suresh, Kamal Faruqui, Manzoor Alam, Maulana Niaz Farooqui, Ram Puniyani, Shabnam Hashmi, Sister Mary Scaria, Syed Shahabuddin, Aruna Roy, Anu Aga, Farah Naqvi, Harsh Mander and Maja Daruwala.

Almost all of them are either Christians, Muslims or rabid anti-Hindu Leftists. From their past actions, most of them seem to have been born with an animus against the Hindu ethos.  They are notorious for their hate mongering proclivity against Hindus.  They are either explicit or closet supporters of violence and discrimination against peaceable and tolerant Hindus.

In India, the Hindu population is more than 80%.  Hinduism is renowned in the world as a religion of tolerance and benevolence towards other religious faiths for thousands of years.  It is a part of the central doctrines of Sanatana Dharma aka Hinduism.  As a testament, we can point out that minorities are today governing India.

UPA Chairperson Sonia (Antonia Maino) Gandhi is a devout, professing Catholic.  She is of Italian origin and she is a naturalized citizen of India.  At marriage, she insisted that her husband Rajiv Gandhi convert to Christianity and that her children be raised as a Christian/Catholic.  Unfortunately, Sonia Gandhi has understood little of the Hindu culture of amity, tolerance, and ecumenism.  Her son Rahul Gandhi is reported to have told the American ambassador Timothy Roemer in 2009 that India is facing a greater terror threat from radical Hindu groups than from Muslim militant 5th columnists.  Both, Sonia and Rahul seem to suffer from an acute case of Hindu phobia; their mindset is unwavering in trying to suffocate and suppress Hindus legally in India.  The aim of this draconian bill is to achieve that goal.

It is interesting to note that Sonia Maino Gandhi’s advisors and ministers are almost all either Christians or Muslims.  A.K. Anthony, Defense Minister; Salman Khurshid, Law Minister; Gulam Nabi Azad, Health Minister; Ahmed Patel, Seniormost Political Advisor; Margaret Alva, Governor of Uttarakhand; and Anil Kumar Brown, also known as "Charlie" Browne, Chief of Air Staff are amongst the most notables. According to http://www.hinduwisdom.info/Glimpses_XVI7.htm, even Ambika Soni, the current Information and Broadcasting Minister of India who sports a big tilak on her forehead like Sonia and Rahul, and whose name sounds like a Hindu is also a Christian. “She is also widely crticized for arm-twisting the media, and trying to gag it”. Five chief ministers in Nagaland, Mizoram, Meghalaya, Kerala and Arunachal Pradesh are also devout Christians.

The noose is being tightened on Hindus.  The situation for Hindus in India, in short, can be described as abysmally apocalyptic even though it is the majority religion of India.  Once this bill is enacted in Parliament, a precariously perilous situation will arise for Hindus.  Hindus must scrutinize and examine the threat emanating from this fraudulent bill.  This bill is downright dangerous for the unity and integrity of India.

It is essential that we should immediately unleash a propaganda blitz in print and electronic media, highlighting the disastrous and deleterious impact the Communal Violence Bill will have on the body politic of India and its majority Hindu civilization.

The survival of Hindus is at stake.  Our future generation will not forgive us if we just succumb under pressure and keep watching from sidelines as a spectator or act like a referee.  We should wake up from the deep slumber, stop internal squabbles, learn to work in unison, and come up with a solid strategy to get rid of anti-Hindu UPA government.

AIADMKS WIN PROVED PEOPLE WERE AGAINST GRAFT

Lauding the people of Tamil Nadu for 'punishing the corrupt,' in the 2011 State Assembly elections, Gujarat Chief Minister Narendra Modi on Saturday said here that the victory of the AIADMK testified that the people were against graft and those who indulge in it. Amid loud cheers, Modi began his speech at the 42nd founding anniversary function of Thuglak magazine with a recital of a couplet from Thirukural which gives advice on good governance. Suggesting that such good counsel never found favour with Congress rulers at the Centre, he said India's economy was bigger than that of China in the 1950s. "Today what is the situation? China's economy is three times the size of India's economy." Modi said it is due to the status-quo policies of the Union government and its concern for power rather than propelling economic expansion.

In a scathing attack, he said while it took over 40 years for the rulers to realize that the policies were not correct, China leaped forward during the corresponding period and made huge economic progress. Even after the so-called liberalization there could not be much progress as only half-hearted efforts were made.

"The UPA regime is the most corrupt after Independence. Corruption has touched new heights during the UPA regime," he said. Stating that several issues including lack of direction and leadership besides vote bank politics had slowed down the economy, he said: "Now, the economic growth rate has declined from 8.5 per cent to 6.9 per cent in the second quarter of 2011-12.

There is no road map for progress, and no vision. The Congress is at a loss to understand as to what is happening around the world." Regretting that despite people's soaring aspirations and willingness to work hard, the country could not move forward due to the flawed attitude of the Centre. "The UPA government is interested only in vote bank politics and the 4.5 per cent quota from the OBC reservation is a case in point." Lambasting the Centre for blocking his government's Organized Crime Bill, he said the Communal Violence Bill proposed by the Centre does not treat a person even as a citizen but labeled them as minority and majority.


HIS HOLINESS SHANKARACHARYA JAYENDRA SARASWATHI URGES HINDUS TO FIGHT AGAINST COMMUNAL VIOLENCE BILL

Communal Violence Bill 2011: His Holiness Shankaracharya Jayendra Saraswathi urges Hindus to fight ultimately.


His Holiness, the Shankaracharya of Kanchi Kamakoti Peeth, Swami Jayendra Saraswathi has called for the one billion strong Hindus of India to stand and fight against the proposed Communal Violence Bill draft. His holiness was speaking at the meeting of the delegates of various Hindu organisations as part of the platinum jubilee celebrations of the Temple Entry Proclamation. The event was organised by the Hindu Aikyavedi at Tiruvanthapuram. The year-long platinum jubilee celebrations were inaugurated by His Royal Highness, Uthradom Thirunal Marthanda Varma, and head of the royal family of Travancore.

Speaking on the occassion, His Holiness said that the bill is an attempt to destroy the unity of Hindus and all must fight against it. His Holiness also spoke about the social reformer Sree Narayan Guru. His Holiness said that the state and the Hindu community at large ows a lot to him. Shree Narayan Guru's fight against untouchability and other inequalities helped the community to remain united.

On this occasion, Kesari editor J Nandakumar also delivered a talk on the proposed Communal Violence Bill. He emphasized that the Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Bill 2011 was aimed at splitting the Hindu community.

Other talks delivered in the meeting included one by Kerala Pulayar Maha Sabha general secretary N K Vasudevan who spoke on Justice Ranganathan Commission report and another by Aikyavedi state secretary Brahmachari Bhargavaram who talked about 'Sree Padmanabhaswamy Temple and Kerala Temples'.

It was an important conglomeration for Hindu community. Around 110 leaders of 61 Hindu organisations attended the leadership meet held as part of the function.

OPPOSE COMMUNAL VIOLENCE BILL - KANCHI SANKARACHARYA


Jagadguru Shankaracharya Swami Jayendra Saraswati of Kanchi Kamakoti Peetham has called upon Hindus to oppose the proposed Communal Violence Bill, vehemently, as it is aimed at splitting the Hindus and creating animosity between Hindus and other religions. He termed it a conspiracy against Hindus and said there is strong opposition for it, even within Congress.

He was inaugurating the VHP-Hindu Aikya Vedi 'Hindu Gaurav Sammelan on November 11 in Thiruvananthapuram to commemorate 75th anniversary of Temple Entry Proclamation of 1936. Following the Vaikom and Guruvayoor Temple satyagrahas, the then Maharaja of Travancore, had opened up the temples for all Hindus on that day.

The present Maharaja Shri Uthradom Thirunal Marthanda Varma, who presided over the function, remembered that Mahatma Gandhi had come to Thiruvananthapuram on January 12, 1937 and said the purpose of his visit was exclusively to offer congratulations to the Maharaja Chitra Thirunal Balarama Varma, as a humble pilgrim, for this epoch-making proclamation.

In the meeting, attended by 3000 delegates, 110 leaders of 60 Hindu organisations including SNDP participated.

The Kanchi Acharya said the Hindus of Kerala owe a lot to Sri Narayana Guru, because for whose presence whole of Kerala would have got converted into Islam or Christianity. He said Hindus should emulate Sardar Patel as a role-model, who not only united Bharat but also rebuilt the Ghazni destroyed Somnath Temple in Gujarat. He said if the present realisation of unity, which the Hindus have now, had been there 100 years before, there would not have been any Christian or Muslim in India.

VHP leader Shri Kummanam Rajasekharan said Sri Narayana Guru, during the Vaikom satyagraha, asked his followers to take pledge that they are Hindus. He said the aims of both NSS and SNDP is Hindu unity and protection of Vedic dharma. He called for unity of all Hindu organisations saying Congress and CPM regimes are trampling the Hindus like Nair, Ezhava, SC/ST and Vanvasis, just because they are Hindus.

Thuravur Suresh, the stormy dalit voice of Hindu Aikya Vedi, said it was only BJP and RSS which are raising voice against the Ranganath Misra Commission, recommending reservation for dalit Christians and Muslims. He ridiculed the Oommen Chandy regime for spending crores to settle dispute between Orthodox and Syrian Churches, whereas even urinals are not available for the crores of pilgrims coming to Sabarimala. A massive public meet was also addressed by the Swamiji, at Gandhi Park.

MANGALORE: MEGA PROTEST AGAINST COMMUNAL VIOLENCE BILL IN CITY

Under the aegis of Hindu Hitaraskhana Vedike, Hindu organizations have made preparations to hold a mega protest at 4 pm on Wednesday November 23 at Nehru Maidan in the city to protest against the provisions of the Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Bill 2011, proposed to be tabled in the parliament during winter session. The organizers expect the gathering to be about 50,000-strong. The organizations have been claiming that certain provisions of the proposed bill are disastrous, and against the interests of Hindus.

Before the meeting, a procession will be taken out from Dr B R Ambedkar Circle in the city at 3 pm, to the venue of the meeting. Spiritual heads of Kolya, Vajradehi, and Manila mutts will participate in the meeting. Muniyappa, organizational head of Dharma Jagagan's Karnataka provincial unit, and Dr Prabhakar Bhat Kalladka, Samparka Pramukh, south central region of Rashtriya Swayamsevak Sangh, will deliver main addresses.

As a prelude to the meeting, various meets, rallies, debates, interactions, etc were held at different places, where efforts were made by different organizations and individuals to make people aware of the negative aspects of the proposed bill. BJP president of city south unit, R Srikar Prabhu, and working president of the Vedike, Ramesh S, said that the protest programme has received wholehearted support from all regions.

Leaders of Hindu organizations like Jagadish Shenava, Manohar Tulajaram, Harish Achar, K T Suvarna, Durga Vahini district Saha Pramukh, Surekha, Akhila Bharat Vidyarthi Parishad divisional organizing secretary, Ramesh, Bajrang Dal convener, Sharan Pumpwel, and Rashtra Sevika Samiti Pranta Karyavahika, Dr Kamala Bhat, have requested the Hindu brethren to take part in the protest programme in full strength, and make it a success.

साम्प्रदायिक एवं लक्षित हिंसा विधेयक 2011 - संविधान में फेरबदल की साजिस - प्रो॰ मधुकर श्याम चतुर्वेदी

साम्प्रदायिक तथा साम्प्रदायिक हिंसा के प्रसार की रोकथाम तथा साम्प्रदायिक हिंसा के शिकार लोगों को प्रभावी प्रतिकारात्मक कार्यवाही के लिए आश्वास्त करने के घोषित उद्देश्य से प्रस्तावित यह विधेयक प्रथम दृष्टता ही स्वयं साम्प्रदायिक मंतव्यों का अग्रसर करता हुआ प्रतीत होता है।

अधिनियम की धारा में ग्रुप शब्द को परिभाषित करते हुए यह घोषित किया गया है कि उसमें भारत संघ के किसी राज्य में धार्मिक और भाषाई अल्पसंख्यक तथा अनुसूचित जातियां और अनुसूचित जनजातियां सम्मिलित मानी जाएंगी। इसी प्रकार धारा 3 में परिभाषित किया गया है कि रिविक्टिम (शिकार) भी वही व्यक्ति माना जायेगा जो कि गु्रप के रुप में परिभाषित किसी समुदाय का सदस्य होगा।

गु्रप या समूह की यह परिभाषा तर्क की किसी कसौटी से संगत नहीं है। यह समूह शब्द की भाषिक तार्किक अथवा विधिक विवक्षाओं की स्पष्टतः अवहेलना है। सामान्यतः भी, और विशिष्टितः साम्प्रदायिक हिंसा और द्वेष के संदर्भ भी यह किस मापदंड से उचित ठहराया जा सकता है कि अल्पसंख्यक समूह ही समूह होंगे और अन्य समुदायों का समूह नहीं माना जाएगा|

जब इस परिभाषा को इस अधिनियम के समस्त प्रावधानों पर लागू किया जाएगा तो उसका सटीक प्रभाव यह होगा कि किसी अल्पसंख्यक समुदाय अथवा कारित हिंसा तो अपराध होगी किंतु इससे भिन्न समुदाय जनजाति के सदस्य के विरुद्ध किसी विद्वेषकारी कथन अथवा कारित हिंसा तो अपराध होगी किंतु इससे भिन्न समुदाय के प्रति व्यक्त की गई दुर्भावना अथवा कारित की गई हिंसा इस अधिनियम के अंतर्गत अपराध की श्रेणी में नहीं आएगी। अधिनियम की यह परिभाषा स्वयं धर्म स्वातंत्र्य के अधिकार की सांविधानिक योजना की अवहेलना है क्योंकि इसके द्वारा साम्प्रदायिकता को क्षमता की अपेक्षा स्वयं साम्प्रदायिक पहचान के आधार पर समझने और समझाने का प्रयास किया जा रहा है। ऐसा प्रतीत होता है कि गु्रप विभेदकारी साम्प्रदायिक मंतव्य पर आवरण डालने तथा उसके आपत्तिजनक स्वरूप को किंचित कमतर प्रतीत करवाने के उद्देश्य में सम्मिलित किया गया है अन्यथा अधिनियम की योेजना में इन वर्गों का उल्लेख प्रासंगिक नहीं लगता क्योंकि इन वर्गों के विरुद्ध अत्याचार की घटनाओं की रोकथाम के लिए पूर्वतः ही एससी/एसटी एट्रोसीटीज एक्ट अस्तित्व में है। यदि ऐसा प्रतीत होता कि इन वर्गों के विरुद्ध किसी हिंसा या अत्याचार के शमन के लिए उक्त अधिनियम के प्रावधान पर्याप्त नहीं है तो उसका निराकरण संबंधित अधिनियम में संशोधन करके किया जा सकता था इसके लिए संविधान की मूल योजना में ही एक वर्ग के रूप में चिह्नित एस.सी./एस.टी. को साम्प्रदायिकता के आधार पर किए जानेवाले किसी वर्गीकरण का हिस्सा बनाया जाना उपयुक्त नहीं था। यह न केवल अनावश्यक अपितु अनर्थकारी है।

संविधान के अनुच्छेद 14 में प्रस्थापित विधि के समक्ष समता और विधि के समान संरक्षण के अधिकार की यह अनिवार्य विवक्षा है कि विधि निर्माण और विधि के क्रियान्वयन में अतर्कसंगत आधारों पर कोई भेदभाव नहीं किया जायेगा। अतर्कसंगत आधारों के अभिकल्पन में विधायिका और कार्यपालिका के असीमित स्वविवेक का परिहार करते हुए अनुच्छेद 15 में वे आधार भी व्यापक रूप से गिना दिए गए हैं जिन्हें प्रथम दृष्टता अतर्कसम्मत माना जाएगा। इन आधारों पर पंथ को भी सम्मिलित करते हुए उसके आधार पर भेदभाव का स्पष्टतः निषेध किया गया है। किसी विधि की परिभाषा में अधिनियम के प्रावधान द्वारा की गई संरक्षा की परिधि में और आपराधिक दायित्व के निर्धारण के संबंध में केवल धर्म/पंथ के आधार पर वर्गीकृत किसी समुदाय विषेश के सदस्यों को सम्मिलित किया जाना विधि के शासन की प्रकट अवहेलना है। इस भेदभावपूर्ण परिभाषा का सहज प्रभाव यह है कि इस अधिनियम के आलोक में किसी भाषाई अथवा पांथिक अल्पसंख्यक समुदाय के विरुद्ध किया गया दुष्प्रचार अथवा हिंसा ही अपराध की श्रेणी में सम्मिलित किसा जाएगा। यह प्रावधान स्वयं में साम्प्रदायिक सौहार्द की अपेक्षा से संगत हो ही नहीं सकता क्योकि इसमें जो प्रकट भावना है वह यह है कि अल्पसंख्यक समुदाय से भिन्न समुदायों के प्रति व्यक्त की गई दुर्भावना व कारित की गई हिंसा साम्प्रदायिक हिंसा नहीं मानी जायेगी। यह तर्क से परे है कि किस प्रकार साम्प्रदायिक मंतव्यों और साम्प्रदायिक कृत्यों को भी अल्पसंख्यक व बहुसंख्यक के वर्गीकरण के आधार पर समझा जा सकता है।

अधिनियम में ऐसे अनेक प्रावधान है जो शासन के इस मंतव्य को रेखांकित करते हैं कि यह अधिनियम साम्प्रदायिक सौहार्द के संवर्द्धन अथवा साम्प्रदायिक विद्वेष व हिंसा की रोकथाम के उद्देश्य से नहीं, अपितु पांथिक अल्पसंख्यकों को अतिरिक्त संरक्षण देकर उन्हें एक वर्ग के रूप में संतुष्ट करने के प्रयास से प्रेरित है। अधिनियम की धारा 21 में साम्प्रदायिक सौहार्द और न्याय के संदर्भ में एक राष्ट्रीय अधिकरण के गठन का प्रावधान है उसमें भी यह स्पष्ट कर दिया गया है कि उसके कुल सात सदस्यों में से कम-से-कम चार अल्पसंख्यक समुदायों से संबंधित ही होंगे।

ध्यान देने योग्य यह है कि स्वयं में धर्म स्वातंत्रय के अधिकार के सन्दर्भ में अल्पसंख्यक और बहुसंख्यक के वर्गीकरण की किसी भी संभावना का स्पष्टतः निषेध किया गया है। अधिनियम में साम्प्रदायिकता की जो परिभाषा दी गई है उसमें भी किसी अल्पसंख्यक धार्मिक समुदाय के सदस्य होने को ही आधार बनाया गया है। यह ध्यान देने योग्य है कि पंथ विषेश की सदस्यता के आधार पर भारत के नागरिक समूह का अल्पसंख्यक अथवा बहुसंख्यक के आधार पर साम्प्रदायिकता के संदर्भ में वर्गीकरण संविधान में स्पष्टतः निषेध किया गया है। साम्प्रदायिकता की रोकथाम और देश के सेकुलर तानेबाने( जैसा कि अधिनियम में साम्प्रदायिकता की परिभाषा के क्रम में अंकित किया गया है) को क्षति पहुंचाने के संदर्भ को यदि मूल अधिकारों के आलोक में समझाने का प्रयास किया जाए तो उसका एकमात्र सन्दर्भ धर्म स्वातंत्र्य के मूल अधिकार में खोजा जा सकता है।

यह ध्यान देने योग्य है कि अनुच्छेद 25 धर्म स्वातंत्र्य धर्म के व्यवहार और प्रचार करने की स्तंत्रता के सन्दर्भ में समान हक को रेखाकिंत करता है। अनुच्छेद 25 की शब्दावली में समान हक शब्दों का प्रयोग संविधान के इस मतंव्य को रेखांकित करने के लिए पर्याप्त है कि धार्मिक अधिकारों के संदर्भ में संविधान अल्पसंख्यक और बहुसंख्यक के आधार पर विभेद या अतिरिक्त संरक्षण को अस्वीकार करता है। संविधान में भाषाई और धार्मिक अल्पसंख्यकों का एक प्रथक वर्ग के रूप में अभिज्ञान केवल शिक्षा और संस्कृति के अधिकार के संदर्भ में किया है। यह अत्यन्त आपत्तिजनक है कि इस अधिनियम के द्वारा संविधान द्वारा प्रत्याभूत मूल अधिकारों की योजना में ही उलटफेर किये जाने का प्रयास किया जा रहा है तथा अल्पसंख्यक और बहुसंख्यक के वर्गीकरण को शिक्षा और संस्कृति से हटाकर धर्म स्वातंत्र्य के अधिकार के संदर्भ में प्रविश्ष्ट करवाने का प्रयास किया जा रहा है। यदि धर्म स्वातंत्र्य के अधिकार में समानता की अपेक्षा अल्पसंख्यक और बहुसंख्यक होने के आधार पर कोई विशिष्ट वर्गीकरण अभिप्रेत है तो शासन को इसके लिए व्यापक बहस आमंत्रित करनी चाहिए और इतना साहस दिखाना चाहिए कि पंथ निरपेक्षता की उनकी दृष्टि में धर्म स्वातंत्र्य के अधिकार का वर्तमान स्वरूप संतोषजनक नहीं है और उसमें अल्पसंख्यक के लिए अतिरिक्त संरक्षण की व्यवस्था किया जाना आवश्यक है।

अधिनियम के समस्त प्रावधानों का इस मूल प्रस्थापना के संदर्भ में परीक्षण किये जाने की आवश्यकता है कि क्या धर्म स्वातंत्र्य के अधिकार के संदर्भ में साम्प्रदायिकता की परिभाषा साम्प्रदायिक हिंसा के लिए दायित्व अथवा अनुतोष की परिगणना के संबंध में भारत के नागरिकों में अल्पसंख्यक व बहुसंख्यक के आधार पर विभेद किया जाना संविधान की मूल भावना तथा पंथ निरपेक्षता की संविधान में घोषित मूल योजना के अनुरूप माना जा सकता है|

दरअसल एन. ए. सी. ने दंगा शब्द की नई परिभाषा ही गढ़ दी है। पहले दो समुदायों के बीच होनेवाली हिंसा को दंगा कहा जाता था लेकिन एन. ए. सी. की इस बिल के मुताबिक दंगे की नई परिभाषा यह है किसी राज्य मे बहुसंख्यकों द्वारा अल्पसंख्यकों के खिलाफ की जाने वाली हिंसा।

न्याय के सामने सबकी समानता के सिद्धांत का इससे बड़ा मजाक क्या हो सकता है कि धर्म के आधार पर अब यह तय होगा कि कौन दंगों जैसे संगीन अपराधों का दोषी होगा और कौन नहीं। इसके लिए कोई कार्रवाई नहीं होगी। ऐसा न्याय तो किसी अंधेर नगरी में ही हो सकता है। यह बिल अगर कानून बन गया तो इस कानून के तहत गोधरा में 60 कारसेवकों को जिन्दा जलानेवाले तो दोषी माने ही नहीं जाएंगे। इसी तरह पश्चिम बंगाल के देगंगा में हाल ही में वहां के हिंदुओं पर अत्याचार करनेवाले मुस्लिम भी साम्प्रदायिक हिंसा के दोषी नहीं होंगे। क्योंकि दोनों राज्यों में हिंदू बहुसंख्यक जो हैं और बिल का मानना है कि साम्प्रदायिक हिंसा केवल बहुसंख्यक ही कर सकते हैं अल्पसंख्यक नहीं।

सेनिया गांधी की अध्यक्षतावाली एन. ए. सी. द्वारा तैयार किया गया इस बिल का मसौदा कांग्रेस के पतन की त्रासदी की कहानी कहता है।

NAC MEDDLING WITH MATTERS FALLING WITHIN THE LEGITIMATE FUNCTIONS OF GOVERNMENT - B. S. RAGHAVAN

 I am not one of those who look upon the National Advisory Council (NAC), functioning under the UPA Chairperson, Ms Sonia Gandhi, as an extra-Constitutional authority, enjoying power without responsibility, and meddling with matters falling within the legitimate functions of the Government. 

I think it is performing the useful role of taking up for advance policy planning issues and contingencies which the Government, because of the day-to-day pressures, has been unable to address, or may have overlooked. The risk of stirring up hornets' nests is inherent in such proactive efforts. The NAC finds itself in one such predicament for coming up with the Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Bill. In sheer scope and volume, it is a remarkable piece of work, extending to 66 pages, containing 138 sections, four schedules and four appendices, and leaving nothing to chance. 

It is under attack principally on two fronts. The first is on the ground of violation of the federal structure of the Constitution and vesting the Centre with a wide range of powers to exercise control over States in the domain of law and order which squarely falls within their ambit. The second objection originally raised by the BJP, and now supported by the likes of the Bihar Chief Minister, Mr Nitish Kumar, and Tamil Nadu Chief Minister, Ms Jayalalithaa, is that it is likely to foment distrust between the majority and minority religious communities and create among the people at large an impression that it is the majority community that is invariably responsible for outbreaks of communal violence. 

SWEEPING AUTHORITY 

In Ms Jayalalithaa's opinion, Central and State authorities may exploit it "to vent frustrations on vulnerable persons, or wreak vengeance against any group that is outspoken or critical" and that the Bill will not "even remotely achieve its desired objective". 

A close reading of the NAC's draft Bill is certain to confirm these apprehensions which are based on sound reasoning. It doubtless upsets the delicate balance in the powers of the Centre and the States, by giving sweeping authority to the former in certain situations to over-ride the Latter, virtually obliterating the States as Constitutional entities. 

For instance, the occurrence of organized communal and targeted violence (a new concept Introduced in the Bill) within a State shall constitute "internal disturbance" within the meaning of Article 355 of the Constitution and the Central Government can then practically take over the State administration for as long as the "internal disturbance" continues in its subjective judgment. 

Likewise, the Bill makes it "the duty" of the Centre, the States and the Union Territories to carry out the directives of the National Authority for Communal Harmony, Justice and Reparation proposed to be established. 

NEBULOUS 

The Bill has also put in problematic definitions with a whole host of subjective elements liable to subjective or biased interpretation and vitiating relations between communities. Take the definition of "hostile environment against a group": The word ‘group’ has been given the connotation of "a religious or linguistic minority, or Scheduled Castes and Scheduled Tribes" and ‘hostile environment' is said to mean creation of an intimidating or coercive environment when a person belonging to the group is subjected to humiliation and harassment, denial of livelihood, deprivation of fundamental rights, or eviction from place of residence. 

Going a step further, the Bill has also conceived of "hate propaganda" as a new offence in the nature of acts inciting hatred, causing clear and present danger of violence against a group or persons belonging to that group. The expressions used are so very nebulous that a person can be hauled up for almost

  • क्या एन. ए. सी. जो कि अनिर्वाचित ढ़ाचा है उसके द्वारा बिल ड्राफ्ट करना असंवैधानिक नहीं है तीसरा व महत्वपूर्ण सवाल है कि क्या बिल की प्रकृति स्वयं में ही साम्प्रदायिक नहीं है जॉन दयाल, अबुसलेह शरीफ, असगर अली इंजीनियर, सैयद शहाबुद्दीन, कमाल फारुकी, सिस्टर मैरी, सोनिया, फरा नकवी, अनु आगा, हर्ष मंदर आदि उन लोगों में से है जो किसी समुदाय विशेष के साथ है जो किसी समुदाय विशेष के कड़े आलोचक हैं। 

TRIPURA GOVERNMENT OPPOSES COMMUNAL VIOLENCE BILL

Tripura2's Left Front government Saturday opposed the proposed communal violence bill, terming it an "infringement" on the rights of the states."The proposed bill would be an infringement on the rights of the states and is bound to seriously impair the federal spirit enshrined in the constitution of India. Therefore, the same should not be pursued," Chief Minister Manik Sarkar said at the 15th National Integration Council (NIC) meeting here."The existing legal framework is adequate to deal with all kinds of law and order situations including the communal disturbances," he said.

The bill, drafted by the Sonia Gandhi-headed National Advisory Council, seeks to protect" groups" from communal violence and harm, describing "religious and linguistic minority, in any state in the Union of India, or Scheduled Castes and Scheduled Tribes" as victims.

Sarkar, also a member of the Communist Party of India-Marxist (CPI-M) politburo, said that the fundamentalist organizations should be firmly dealt with and should not be allowed to create any communal disturbances in the country.

"An appropriate development strategy can play a crucial role in promoting national integration, “he said adding that all the national and regional political parties should launch an all out ideological and political campaign to promote national unity and integration. (IANS)

THE DRAFT AND THE HORROR OF IT

With such utterly ridiculous clauses just imagine the kind of case scenarios that could emerge: Scenario1: Two bicycles collide on a street. It is just an accident, which might lead to a small quarrel. If one of the cyclists happens to be a member of the Minority community he can invoke this Act by virtue of his being from the ‘non-dominant group’. He is not just another individual; he is always from a ‘non-dominant group’. We must remember that many communal clashes in our country begin with such frivolous incidents only.

Scenario 2: A person approaches some house for rent. The house owner refuses to give his house on rent for whatever reason. This is a very common thing in our country. House owners have various considerations including vegetarianism etc. But in this particular case if the person asking for rent happens to be a person from the Minority community the house owner can refuse his offer only at his own peril. It can be interpreted as ‘public humiliation’ as defined in Art 3 (f) (ii); or ‘depriving of fundamental right’ as in Art 3 (f) (iii); or even Art 3 (f) (iv) or (v). Scenario 3: If a teacher, as part of his lecture, makes some comments on, say, the 9/11 terrorist attack on the US, any student in the class belonging to a ‘non-dominant group’ may interpret it as causing ‘psychological harm’. Or if a Ramdev Baba or some other Swami says that India should have a Uniform Civil Code as per the Directive Principles of our Constitution, he might be dubbed as indulging in creating ‘hostile environment’ as any member of the ‘non-dominant group’ may stand up and say that he was hurt ‘mentally and psychologically’ by the comments of the Swami.

Eminent columnist and thinker Swapan Dasgupta has very rightly pointed out the absurdity ofthese definitions in one of his articles. He wrote in his column titled ‘NAC’s Bill would land Dikshit in jail”: “Amid the annual madness over college admissions, Delhi is witnessing a sideshow in St Stephen's College, which its Principal has described as a "national treasure". It seems that Sandeep Dikshit, a Delhi MP and son of Chief Minister Sheila Dikshit, was dropped as the alumni representative on the college's governing body. The college authorities say that Dikshit hadn't attended a single meeting since 2009 and Dikshit has retorted that St Stephen's has lost the plot and functions like a "communal institution." In reply, Principal Valson Thampu has charged Dikshit of failing to distinguish between communalism and "minority rights." Despite the headline-grabbing potential of anything to do with St Stephen's, this controversy is somewhat stale, and unless someone says something rash, is certain to peter out in the coming week. However, my reason for invoking this minor skirmish is different. If the Communal Violence Bill (CVB) as drafted by the National Advisory Council is passed by Parliament, it is entirely possible that the Congress MP for East Delhi could well be confronted with a non-bailable warrant on the charge of creating a "hostile" and "offensive environment" against a minority institution [clause 3 (f) (5)]. A member of a minority group could walk up to any Police Station and submit that Dikshit's expression of disgust with St Stephen's had contributed to his "mental" and "psychological" harm [clause 3 (j)]. He would claim that Dishit's outburst "could reasonably be construed to demonstrate an intention to promote or incite hatred" against the Christian minority [clause 8]. Since the proposed legislation stipulates that "Every Police Officer shall take action, to the best of his or her ability, to prevent the commission of all offences under this Act" [clause 18 (2)], the relevant thana will have to register a case under the new legislation.

Nor can the politician in Dikshit brush off the case as yet another occupational irritant whose handling is left to a lawyer and forgotten. The CVB is explicit that "unless otherwise specified, all offences under this Act shall be cognizable and non-bailable" [clause 58].”

Having thus established a victim, a crime and an alibi the draft Bill goes on to fix the perpetrators. ‘Knowledge is dangerous’ is a parody to the maxim ‘ignorance is bliss’. But the saying is literally true for the majority community in the context of this draft Bill. In any given incident the knowledge that the person with whom you are engaging is from the non-dominant (read Minority) group compounds your crime according to Art 4 of the draft Bill. That means the Majority community has to be doubly careful with known people from the Minority community since any conflict with them will immediately construed as a wanton attack on the entire Minority community. The flip side is that a person from the Minority community can more easily fix a known person – a friend or a neighbor – in any crime using this Bill.

Read the relevant Art 4 (a):

4. Knowledge.- A person is said to knowingly direct any act against a person belonging to a group by virtue of such person’s membership of that group where:

(a) he or she means to engage in the conduct against a person he or she knows belongs to that group;

Art 7 of the draft Bill defines ‘sexual assault’. It is by far the most widely covered definition that is very much needed to protect women from becoming targets of sexual violence as part of communal violence. But again the problem is that this definition is applicable to the women belonging to Minority group and women of the Majority community can’t benefit from it.

Secondly, it also states that in a case of communal violence sex by consent also can be construed as a crime.

The relevant sentence is here:

Provided that where sexual assault under sub-section (a) or (b) is committed as part of or in the course of organised communal and targeted violence, it shall not be necessary to prove that the said act was committed against the victim without their consent or against their will.

Ideally such a protection should be available in all cases of violence against women in all situations. But one cannot forget cases like Jhabua Nuns Rape Case and Kandhamal NunRape Case where the nuns had used false cases of sexual assault to implicate and harass people of the Majority community. Under this present draft too such a possibility becomes much more convenient to make false allegations of sexual assault.

Art 13 & 14 are about the dereliction of duty by the public servants. Both the articles want to make the government officials and the personnel of the security forces accountable for communal violence. While Art 13 defines what constitutes ‘dereliction of duty’ Art 14 wants to punish the officers of the security agencies including the personnel of the Army in case of their failure to quell violence or prevent it. The language and idiom of the articles suggests that the drafting committee is convinced that as a general case they tend to behave in a biased manner.

Then comes another draconian article. Art 15 is about holding higher ups in the hierarchy of the organisations responsible vicariously for the acts of individual members. According to this article “breach of command responsibility” of the superiors is also an offence. What it means is that if a member of an organization is found to be the perpetrator of the so-called communal and targeted violence the higher ups in the organization, even if they are not directly involved in any action, will be held vicariously responsible.

Relevant article reads thus:

(1) Whoever, being any non-state actor or superior or office-bearer of any association as defined under clause (b) of section 3 of this Act and other than those mentioned under section 14, in command, control or supervision of any association or assuming command vested in him or her or otherwise, fails to exercise control over subordinates under his or her command, control, supervision and as a result of such failure offences under this Act are committed by subordinates under his or her command, control or supervision, shall be guilty of offences committed by such subordinates under his or her command…

Thus even the perpetrators and the accused have also been defined by these articles. They include actual perpetrators who will always be from the dominant – read Majority – group; government officials in the said jurisdiction for dereliction of duty; police, paramilitary and the armed forces personnel; and leaders of the organisations whose members are accused to be the perpetrators. That means if an incident under this Act is reported then the accused wouldn’t include just those who committed violence, but also those government officials and security personnel who are posted in the region as well. This is because the draft committee believes that a communal incident may happen not in spite of every precaution by the officials, as is thenormal understanding but BECAUSE of the active connivance of them with the perpetrators. Reason, the learned drafting committee members explain, is that they all belong to the Majority community only.

सांम्प्रदायिक एवं लक्षित हिंसा रोकथाम विधेयक 2011 एक खतरनाक और घातक बिल - आर॰एन॰पी॰ सिंह

1॰     विधेयक दंगों के लिए हिंदुओं को जिम्मेवार मानता है। इस विधेयक की आधारभूत मान्यता ही गलत है। यह सच्चाई के बिल्कुल विपरीत है। प्राप्त विवरण के अनुसार भारत में पहला साम्प्रदायिक दंगा 1713 में अहमदाबाद में हुआ था। उस समय से आज तक के दंगों के कारण देखें तो मुख्य रूप से उनके कारण इस प्रकार मिलते हैं।
2॰     मस्जिद के पास गाजे बाजे बजना
3॰     मस्जिद या किसी मुसलमान पर गुलाल के छीटें पड़ना
4॰     पूजा स्थान पर किसी समुदाय विशेष का कब्जा
5॰     पूजा स्थल की जमीन पर किसी प्रकार का विवाद
6॰     मस्जिद के बगल से हिंदू जुलूस का निकलना
7॰     हिंदू जुलूस पर पथराव
8॰     धार्मिक चिन्ह को अपमानित करना
9॰     किसी दूसरे समुदाय द्वारा धार्मिक जुलूस को रोकना

22॰    उपरोक्त सभी कारणों से यह तो स्पष्ट हो जाता है कि सांप्रदायिक दंगे किसी एक वर्ग विशेष की उपज नहीं अपितु यह समय एवं तात्कालिक कारणों पर आधारित होती है। इसीलिए केवल बहुसंख्यकों को साम्प्रदायिक दंगों के लिए जिम्मेवार नहीं ठहराया जा सकता।

RETURN OF JINNAHISM

For a full 19 days Mahatma Gandhi had walked up the steps of Jinnah’s residence in 1946 with the sole objective of persuading him to give up his demand for the partition of India into Hindu and Muslim states. Jinnah refused to budge even an inch. He was not even ready to accept the olive branch extended by Gandhiji that he could take over the reins of power from the British and become the first ruler of Independent India.

For Jinnah all this placation and mollification appeared mischievous. “Independent India will be Hindu India”, he declared and insisted that once the British had left the Muslims would become second-class citizens under the Hindu majority. That is why he insisted that the British should grant his demand for a separate Pakistan for Muslims before they leave the shores of India. When Gandhiji gave a call to the British to ‘Quit India’, Jinnah countered with his call ‘Divide and Quit’.

The country thought that the perversion of the Majority-Minority debate had ended when the country was divided. But it has been proved wrong time and again. The present draft Bill is a standing proof that Jinnahism – the belief that the Minority is perpetually oppressed in India by the Majority – is still alive and kicking. Jawaharlal Nehru used to say: “Those who forget history are condemned to repeat it”. We have not learnt any lessons from history. And we continue to commit blunders. This draft Bill, if passed into becoming an Act, would be another big blunder we would be committing.

Communal harmony is paramount in any country that has multiple religions and communities. We must strive hard to train and educate people in harmonious cohabitation. Where it is necessary we may introduce some laws and regulations also. But all that should promote harmony. The present Bill, unfortunately, will only promote disharmony. With these kind of laws the LeTs and HuJIs across the border need not have to promote terrorism in our territory anymore. All that they need to do is to encourage a minor communal riot and they can achieve what they want – huge rift between the Majority and Minority communities. This Bill doesn’t deserve to be placed before the Parliament. It should be withdrawn by the NAC forthwith.

RETHINK THE COMMUNAL VIOLENCE BILL - ASHUTOSH VARSHNEY

Minority protection


Group entitlements imprison individuals and societies, inexorably pushing them towards dangerous collective identities.

Does this position imply that minorities can do no wrong? Is the majority community always to blame? By the 1940s, thinking long and hard about this question, Jawaharlal Nehru had started distinguishing between minority communalism and majority communalism. Both were bad, but majority communalism was infinitely worse. Nehru detested Jinnah's communalism, but called Hindu communalism the greatest danger to India.

This position does not imply that minority communalism ought to be ignored. Nehru had harsh words to say about Muslim organisations and leaders during a Hindu- Muslim riot in Aligarh in 1954, and wanted those organisations punished. My own research in Hyderabad uncovered many instances when Muslim organizations were egregiously complicit in riots. Hyderabad's mass killers came in both hues, Hindu and Muslim; Hindus had no monopoly over rioting. Other researchers came to similar conclusions. Agar Hindu pachees Musalman marenge, said Hyderabad's Muslim wrestlers to Sudhir Kakar, a psychologist who also researched violence, to hum chhabbees Hindu marenge - yeh jo riot hai, woh one-day cricket ki tarah hota hai (if the Hindus kill 25 Muslims, we will kill 26 Hindus - a riot is like a one-day cricket game).

In sum, therefore, fundamentally because of the easy, though erroneous, equation ofmajorities with nationhood, a democracy must protect its minorities from violence. The NAC is right to emphasise the vulnerability of minorities and to stress that the Indian state can behave in a highly majoritarian fashion. But do we need a new law?

The second important aspect of the bill is its insistence that if "communal and targeted violence" against minorities takes place, it will automatically be assumed that the civil servant in charge of law and order has not exercised "lawful authority vested in him or her under law" and he or she "shall be guilty of dereliction of duty". The bill makes civil servants legally liable for riots. They will be fired, demoted or reprimanded, if a riot takes place on their watch. 

The NAC's assumption is that if civil servants were personally liable for riots, there is a greater chance they would act according to the rule-book, and not wait for political signals from above. But this assumption can only be half-right. The NAC has not confronted a factual question. Why has Aligarh been so riot-prone, whereas Bulandshahr, a town next door, has rarely had a communal riot? Why have Meerut and Morabadad been so communally nasty, 

whereas the neighbouring Muzaffarnagar and Bareilly hardly ever witnessed a communal riot after independence? Did Aligarh, Meerut and Moradabad have riots because the civil servants stationed there ignored, or supported, the killing of Muslims, or is there something about the local relations of Hindus and Muslims in these towns that made them riot-prone? 

Indeed, during 1950-95, as I calculated in my book on communal violence, a mere eight cities of India - Mumbai, Ahmedabad, Baroda, Hyderabad, Aligarh, Meerut, Delhi and Kolkata - had nearly 46 per cent of all deaths in Hindu-Muslim riots. Did these eight cities have repeated "dereliction of duty" by civil servants? Did the peaceful cities have especially duty-driven officials and police forces? 

When I asked why he succeeded in keeping peace in smaller towns of Maharashtra but, in 1984, failed to prevent an awful communal riot in Mumbai and later in Ahmedabad, Julio Ribeiro, an outstanding police officer of post-1947 India whose commitment to duty has never been questioned, said that there was something about how social and economic life was organised in Mumbai and Ahmedabad, which made his task enormously difficult. The same question - why riots in some places, not in others - elicited an identical answer from most police officers and civil administrators I interviewed in my 10-year long study of communal violence. Would the NAC fire a Ribero, and others like him, for their inability to prevent riots? 

Riots are jointly produced. They are, in part, an outcome of how the police officials and civil administrators have performed their constitutionally assigned functions. Rioting is also, in part, a result of how social and economic life is organised in a town, whether Hindus and Muslims are segregated or integrated, and what incentives or capacities such local structures have created for politicians, always insearch of political gains, to inflame and polarise, or calm and unite, local communities. The same IAS officer who functioned well in Warangal often felt helpless in Hyderabad. The NAC would like to give more powers to the civil servant. But if riots are jointly produced by the state and society, dealing with one side of the equation is surely not enough. 

The bill also envisions creation of a new set of state institutions: a National Authority for Communal Harmony, Justice and Reparation, headquartered in Delhi. There will be corresponding institutions at the state level, too. A massive bureaucracy will thus be created. 

This great institutional proposal invites a basic question: Does the NAC expect the future of India to be as riot-ridden as India's past has been? Massive law-and-order bureaucracies are normally created to deal with a frequently recurring problem, not for something highly infrequent or rare. We need to ask if riots will be occasional episodes, or regular occurrences, in the coming years. If riots are going to be occasional, we can't justify the creation of a huge permanent bureaucracy.

The NAC appears to be a prisoner of India's past, especially of Gujarat 2002. What happened in Gujarat was a crushing embarrassment for all liberal Indians and every effort should be made to punish the guilty, but to build a new bureaucracy to prevent another Gujarat 2002, which is in any case unlikely in the future, will be a terrible mistake.

क्या भारत में बहुसंख्यक समाज दंगाई एवं अल्पसंख्यक सदैव पीड़ित हैं ? - अलोक कुमार

यह जो नया कानून प्रस्तावित किया गया है, इसका इरादा बताने के लिए, इसका नुकसान बताने के लिए किसी भाषण की जरूरत नहीं है। केवल कानून में धारायें क्या हैं यह बता दी जाये तो वे स्वयं से स्पष्ट कर देती हैं कि इस कानून का इंन्टेन्ट क्या है और उसका नुकसान क्या होगा।

मैं क्योंकि पेशे से वकालत भी करता हँू इसलिए तीन धारायें ऐसी हैं जिनको मैं बिल में से पढ़कर के आपको बताना चाहूँगा। उसके बाद हम लोग उसके आगे चलेंगे।

इसमें एक नया शब्द है, वह शब्द है ’ग्रुप‘ (समूह)। ’गु्रप‘ की जो परिभाषा है वह सेक्शन 3 ई में कही गयी है। इसमें चार तरह के लोगों को शामिल किया गया है। प्रत्येक राज्य में जो धार्मिक अल्पसंख्यक हैं उनको; जो भाषाई अल्पसंख्यक हैं उनको उस राज्य के अनुसूचित जाति और अनुसूचित जनजाति को। अब यह स्पष्ट है कि अनुसूचित जाति और अनुसूचित जनजाति के लिए पहले से भी बहुत सारे कानून हैं। वे सारे कानून देश की व्यापक सहमति से बने हैं। उनके लिए आरक्षण भी सर्वसम्मति से हुआ था। इनको अलग से विशेष कानून की जरूरत नहीं थी। इन्हें तो केवल इसलिए रखा गया है कि यह कहा जाये कि देखो केवल अल्पसंख्यक ही नहीं हम एम.सी./एस.टी. को भी शामिल कर रहे हैं। जो भाषाई अल्पसंख्यक हैं, कभी-कभी कोई राज ठाकरे विषय उठा लेते हांेगे, लेकिन भाषाई अल्पसंख्यकों के खिलाप कोई दंगा या लड़ाई हो रही है, ऐसी कोई बढ़ी घटना भी देश में नहीं हो रही। अब रह गये धार्मिक अल्पसंख्यक। धार्मिक अल्पसंख्यकों को देश भर में, जिस राज्य मे जो अल्पसंख्या में हैं, उसके आधार पर देखा जायेगा। जम्मू-कश्मीर में यह कानून लागू नही होगा यह इसमें लिखा है। इस देश में पारसियों व यहूदी  समाजों से तो कोई किसी प्र्रकार का विवाद होता नहीं, तो मुख्य तौर दो ही बड़े धार्मिक अल्पसंख्यक समुदाय के बारे में यह बिल फोकस करता है।

दूसरी परिभाषा है ’विक्टिम‘ (पीड़ित) की। यह शुरू होता है, Þvictim Means any person belonging to a group…. माने ने पीड़ित से तात्पर्य है कि ’गु्रप‘ का कोई व्यक्ति। आप देखें। इस बात को कानूनी मान्यता हो गई कि हर मामले में, जहां कहीं भी दो पक्ष हैं एक बहुसंख्य है और दूसरा अल्पसंख्यक है, तो पीड़ित जो हैं, वह धार्मिक अल्पसंख्यकों में से ही हो सकता है। यह वह तर्क है जो दुनियाँ भर में हमारे विरोधी देते हैं।

तीसरी परिभाषा है जो मैं चाहूंगा कि थोड़ा विस्तार से देखें। परिभाषा यह हैः “communal and targeted violence” means and includes any act or series of acts, whether spontaeous or planned, resulting in injury or harm to the person and or property, knowingly directed against any person by virtue of his or her membership of any group. पहला हिस्सा है- ’एनी एक्ट या सीरीज एक्ट्स। यानि झगड़े की कोई एक घटना भी उसमें आएगी। ’स्पौनटेनियस‘- माने पहले से योजना न हो, मौके की गरमी पर झगड़ा हो जाए तो भी वह इस एक्ट में शामिल होगा। ऐसे सब झगड़े जिसमें अल्पसंख्यक समाज के किसी व्यक्ति को या उसकी सम्पति को, कोई भी कितना सा भी नुकसान हो जाए तो एक्ट लागू होगा, अगर जानबूझकर यह झगड़ा इसलिए किया गया है कि अगला व्यक्ति अल्पसंख्यक है। अब आप कहेंगे देखो-देखो बचाव हो गया। आम झगड़ा इसमें शामिल नहीं हुआ। अगर तुम किसी से इसलिए लड़ते होे कि वह अल्पसंख्यक है, तभी यह कानून लागू होगा। मैं कहूंगा कि आपने अभी पूरा कानून नहीं पढ़ा। सेक्शन चार एक प्रिजम्पशन क्रिएट करता है। वह कहता है कि जिसमें झगड़ा हुआ है अगर उसके प्रतिपक्षी को मालूम है कि वह अल्पसंख्यक है तो यह मान लिया जायेगा कि उसने यह झगड़ा इसीलिए किया है।

अब कल्पना करिये एक दृश्य की। बहुसंख्यक समाज के किसी व्यक्ति का अल्पसंख्यक समाज के किसी व्यक्ति से किसी लेन-देन के किसी सवाल पर झगड़ा हो जाए। दिल्ली में तो पार्किंग इतनी कम हो गयी है कि स्कूटर यहां पार्क क्यों किया, कार वहां पार्क क्यों की, इसके लिए झगड़ा हो जाता है। ऐसे किसी भी दो आदमियों के व्यक्त्गित झगड़े में, जब पुलिस आकर गिरफ्तार करेगी तो पूछेगी आपका नाम क्या है ? आप कहेंगे ’राम प्रसाद‘, तब पुलिस कहेगी ’अरे तुम राम प्रसाद हो‘ तो सुनो, यह अपराध कोग्निजेबल है। यह गैर-जमानती अपराध है। जिसमें 10 साल तक की कैद हो सकती है। तुम कोट में जमानत की याचिका दो, कोर्ट चाहेगी तो देगी नहीं चाहेगी तो नहीं देगी। दूसरे से पूछा जायेगा कि आपका नाम क्या है वह अल्पसंख्यक होगा तो कहना पड़ेगा “आहो आप तो अल्पसंख्यक समाज के हैं, आप पर 107-151 लगा रहे हैं, आपको हम पर्सनल बौंड पर ही छोड़ देेते हैं।” अब इस दृश्य की निष्पति को थोड़ा आगेे बढ़ाइये। जिस मौहल्ले में ये दोनों रहते हैं, वहां के समाजों को जब समाचार मिलेगा कि रामप्रसाद इसलिए जेल में रहेगा क्योंकि वह एक समाज का है और दूसरा व्यक्ति इसलिए जमानत पर बाहर आ गया क्योंकि वह दूसरे समाज का है तो क्या केवल इतनी ही बात दोनों समाजों के लिए परस्पर वैमनश्य का कारण नहीं बन जायेगी ? क्या यह मुद्दा र्व्यिक्तगत झगड़े से उठ करके दो समुदायों का झगड़ा नहीं हो जायेगा ? क्या दो लोगों का छोटी सी बात के लिए हुआ झगड़ा उस मौहल्ले में, उस शहर में, उस राज्य में साम्प्रदायिक वैमनश्य का आधार नहीं बन जायेगा ? इतना खतरनाक है यह बिल।

यह तो व्याख्या मैंने कर दी न आपको। वे क्या कहते हैं जिन्होंने यह बिल बनाया है। क्यों बनाया है यह बिल ? उनका तर्क सुनिये। वे कहते हैं, ’देयर इज ए इन्स्टीट्यूशनल बायस इन दी, सोसायटी, इन दी गवर्नमेंट, इन दी ब्यूरोक्रेसी, इन दी पुलिस फोर्सेज एण्ड दा आर्म फोर्सेज अंगेस्ट दी माइनोरिटीज नीड् स्पेशल प्रोटेक्शन एण्ड सेफ गार्डस फोर देयर लाइफ एण्ड प्रोपर्टीज‘। क्योंकि पूरे के पूरे समाज में, इसकी सरकार में, इसकी पुलिस में, इसकी फौज में और इसके सामाजिक संगठनों में एक संस्थागत विद्वेष है (इन्स्टीट्शनल बायस) मुसलमान और इसाई के खिलाप। इसलिए यह बिल सरकार को नियंत्रित करता है, संस्थाओं को नियंत्रित करता है, प्रशासन को नियंत्रित करता है कि इन सबके सामूहिक प्रहारों से इस देश के अल्पसंख्यकों की रक्षा की जाये।

यदि मुझे यह पता नहीें होता यह भाषण राष्ट्रीय सलाहाकार परिषद के लोंगों ने प्रस्तावना में लिखा हुआ है, मैं इस भाषण को अलग से पढ़ता, तो मैं सोचता कि मैं सम्भवतः संयुक्त राष्ट्र संघ के अन्दर पाकिस्तान के प्रतिनिधि का भाषण पढ़ रहा हूँ। यह कानून में लिखी अवधारणा है कि इस देश का बहसंख्य समाज, यह आक्रमणकारी है यह जो कानून में बताई गई अवधारणा है कि इस देश की अल्पसंख्यक पीड़ित हैं, क्या यह भारत के सत्य को घोषित करता है। क्या यह वर्तमान समाज और समय की सच्चाई को घोषित करता है ?

मैं कई बार सोचता हंू कि यह लायें क्यों भाई ? देश में अब से पहले जो दंगा हुआ था, वह 2002 में हुआ था। उसके बाद तो कोई देश में बड़ा दंगा नहीं हुआ। दिल्ली में जो बड़ा दंगा हुआ था, इसके पहले, वह तो 1984 में हुआ था। उसके बाद तो कोई बड़ा दंगा नहीं हुआ। नौ सालों से इस देश में कोई दंगा नहीं हुआ। सबने कहा कि बिहार का चुनाव, मध्य प्रदेश का चुनाव ये बिजली के, सड़क के, पानी के व विकास के मुद्दों पर हुआ है, धार्मिक आधार पर नहीं हुआ। जब सम्प्रदायों के लोग मिलकर रहना सीख रहे हैं, जब चुनावों के अंदर कोई एक समाज लामबंद हो कर के किसी राजनीतिक दल को हराने के लिए इकट्ठा नहीं हो रहा है; सौहार्द्र का वातावरण बना है; समन्वय का वातावरण आगे बढ़ रहा है, तब यह बिल क्यों लाए ? जो दंगे हुए भी उन्होंने पूरी राष्ट्रात्मा का झकझोरा था। उन्होंने पूरी सिविल सोसायटी को, फोर्स को, प्रशासन को सब को खड़ा किया था कि दंगा नहीं होना चाहिये। हुआ तो रुकना चाहिए। दोषियों को दण्ड मिलना चाहिए।

जब दंगे नहीं हो रहे, तब दंगों के बारे में कानून को लाने की जरूरत क्या थी ? मेरा इस बारे में कुछ आकलन है। मैं उसे थोड़ी देर बाद आपसे कहूंगा।

इस कानून के अंदर कौन-कौन आते हैं ? इसमें परिभाषा दी गयी है ’एसोसिएशन की‘, इट मीन्स एनी कॉम्बिनेशन ऑफ बॉडी ऑफ इन्डिविजुअल्स, यानि व्यक्ति का कोई भी संस्थागत समूह। रजिस्टर्ड हो-अनरजिस्टर्ड हो, किसी लेबल पर काम करते हों। पूज्य स्वामी जी विश्व हिन्दू परिषद में काम करते हैं, कोई आर्य समाज में काम करता हो सकता है, इसमें ’एसोसिएशन‘ पर भी शिकंजा कसा गया है। अगर कहीं चार लोग अल्पसंख्यकों से झगड़े में संलिप्त होते हैं, और यह पाया जात है कि चारों लोग फलाने संगठन के सदस्य हैं, आर्य समाज के सदस्य हैं, आरोप लगता है कि आर्यसमाज की विचारधारा या प्रभाव से झगड़े में लिप्त हो गए, तो उस संगठन के प्रमुखों को इस बात कि लिए गिरफ्तार कर लिया जायेगा और दण्डित किया जायेगा कि वे अपने सदस्यों का नियंत्रण करने में असफल हो गये। फिर से सुनिए, यह आरोप लगाने की जरूरत नहीं है कि तुमने उकसाया। यह आरोप लगाने की जरूरत नहीं है, कि तुम्हारे संगठनों ने योजना बनाकर दंगा करवाया। यह आरोप लगाने की जरूरत नहीं है कि ऊपर से नीचे तक इसके बारे में कोई सहमति या जानकारी थी। वह चारों उस संस्था के थे ना, तुम इसके पदाधिकारी हो। तुम रोक नहीं सके, तुम्हें जेल जाना होगा। दस साल के लिए जेल जाना होगा।

अफसरशाही तुम्हारे जिले में दंगा हुआ ना, तुम कलेक्टर हो ना, यह ’ब्रीच ऑफ कमांड रेस्पोंन्सिबिलिटी‘ हुई, तुम्हें दी गई व्यापक जिम्मेवारी का भंग हुआ। तुमको जेल जाना होगा। कितना ही अच्छे से काम किया हो, कितनी न्यायप्रियता से काम किया हो। कितना भी तुरंत काम किया हो। तुमको जेल जाना होगा।

एक नयी परिभाषा बनायी है, ’हेट प्रोपैगैण्डा‘ (घृणा का प्रचार) अगर आप अप्रिय लगने वाली बातों को कहते हैं, जिससे कि अल्पसंख्यकों को किसी विषय पर नाराजगी होे सकती है, तो हेट प्रोपैगैण्डा के दोषी पाए जायेंगे। मैं कार्यक्रम में गया था, वह आर्य-समाज मंदिर में कार्यक्रम था, स्वामी दयानंद का चित्र लगा था, पाखण्ड खण्डिनी पताका को धारण करके वह बढ़ रहे थे। मेरे मन में कल्पना आई कि शिव की नगरी बनारस में, शिववालय के सामने खड़े हो के निर्भय दयानंद कहते हैं यह जिसको तुम अंदर पूज रहे हो, यह पत्थर है, भगवान नहीं है। भगवान तो निराकार है। मुझे संतोष हुआ कि दयानंद बहुत साल पहले हो गये थे, आज हुए होते तो कहते ’हेट प्रोपैगैण्डा‘ किया है, स्वामी जी आप जरा 10 वर्ष के लिए ए॰ राजा के साथ के जेल रहिये।

वैसे हिन्दू-हिन्दू के बारे में कहेगा तो यह लागू नहीं होगा हिन्दू मुसलमान के बारे में कहेगा तो लागू होगा। मान लो कोई कहे कि भाई इस युग के अन्दर जब महिलायें आगे बढ़ कर पुरूषों के साथ काम कर रहीं हैं, यह बुर्का पहनने की जो प्रथा है, प्रतिगामी प्रथा है। मानलो आप उन्हें कहें, एक पुरूष चार पत्नियां रखे, यह प्रतिगामी प्रथा है। इसलिए इस्लाम में सुधार होना चाहिये। मानलो आप अगर कहें, कि शरियत का कानून की किसी ने चोरी की है, उसके हाथ काट डालो, यह कानून कालबाह्य हो गया है, तो डरी हुई ब्यूरोक्रेसी कहेगी, ओहो, इससे तो घृणा फैल सकती है, इसको गिरफ्तार कर लो।

कोई शिकायता कर दे आपके खिलाप कि आपने ऐसा कहा, शिकायतकर्ता की पहिचान को गुप्त रखा जायेगा। आपको नहीं पता लगेगा कि किसने शिकायत की है, आपको गिरफ्तार किया जायेगा। और सुनिये! इस बात को साबित करने की जिम्मेवारी सरकार पर नहीं होगी, शिकायतकर्ता पर नहीं होगी, कि आपने वाकई ’हेट पोपैगैंण्डा‘ किया। इस बात को साबित करने की जिम्मेवारी कानून आप पर डालता है कि आप सिद्ध करें कि आपने ’हेट पोपैगैंण्डा‘ नहीं किया। कैसा कानून है भाई यह ?

जब यह कानून पहले प्रस्तावित किया गया था, तब यह कहा गया था कि इस कानून के संचालन के लिए जो न्यायालय में जो पब्लिक प्रोसीक्यूटर हैं उनमें से एक-तिहाई ’ग्रुप‘ के होंगे। वोे तो हटा दिया गया। पर जो रखा गया वह क्या है ? पब्लिक प्रोसीक्यूटर वह ऑफिसर होता है जो न्याय के हित में निष्पक्ष रूप से काम करता है, सरकार का वकील। वह शिकायतकर्ता का वकील नहीं होता, वो मुल्जिम का वकील नहीं होता, वह न्याय का वकील होता है। इस बिल में यह प्रावधान किया गया है कि अगर शिकायताकर्ता को या इनफोर्मर को लगता कि पब्लिक प्रोसीक्यूटर उसके हित में काम नहीं कर रहा है, तो वो उसकी शिकायत कर सकता है। सरकार उस शिकायत की जाँच करके पब्लिक प्रोसीक्यूटर को बदलेगी। पब्लिक प्रोसीक्कूटर का रोल बदल दिया गया। उसको न्याय के लिए काम नहीं करना है, बल्कि शिकायताकर्ता के लिए काम करना है। उसके जिम्मे यह अगला दायित्व भी डाला गया हर तारीख के बाद मे वह शिकायताकर्ता को सूचित करेगा कि सर! आपके मुकद्दमे में यह कार्यवाही हुई है।

जिले के सुपरिटेंडेट ऑफ पुलिस के बिल में यह दायित्व डाला गया, अपराध की जांच से प्रत्येक चरण में वह शिकायताकर्ता को सूचित करेगा, कि सर आरोपी को जमानत की अर्जी लग गयी है कल। और सर! उसकी जमानत हो गयी है, उसकी विडियो रिकॉडिंग में आपको भेंट कर रहा हँू। आज यह पता लगा है, कल उससे पूछताछ करेंगे। कैसा कानून होगा और इस कानून की पूरी देेखभाल की जिम्मेदारी किसकी होगी ? इस कानून की देखभाल की जिम्मेदारी के लिए एक नेशनल अथॉरिटी (राष्ट्रीय प्राधिकरण) बनेगा। नेशनल अथॉरिटी में सात लोग चुने जायेंगे। इन सात में से अध्यक्ष और उपाध्यक्ष समेत चार सदस्य इस ’ग्रुप‘ के ही होंगे। तो अगर ये जाँच करेंगे ये इन्स्टीट्यूशनल बायस नहीं होगी ? माइनोरिटी की बहुमत वाली अथोरिटी जाँच करेगी मेजोरिटी के अपराधों की।

उससे भी आगे की बात यह है, इन सातों को चुनेगा कौन ? इनकी अहर्ता क्या होगी ? एलिजीबीलिटी क्या होगी ? क्या यह होगा कि कोई सर्वोच्च-न्यायालय का जज रहा हो तो वही हो सकता है ? यह नहीं, ऐसा कुछ नहीं। कोई भी व्यक्ति जिसका साम्प्रदायिक सौहार्द्र के लिये अच्छा रिकॉर्ड हो, वह हो सकता है। ।े अंहअम ंे चवेेपइसमण् चुनेगा कौन ? यू॰पी॰एस॰सी॰ या राष्ट्रपति ? आप चौंकिएगा मत। मैं गम्भीरता कह रहा हूँ, मूल प्रावधान कहता था कि इसको चुनेंगे मुलायम सिंह और मायावती। क्योंकि इनको चुनने वाले लोग हैं- प्रधानमंत्री, गृहमंत्री और संसद में सभी मान्यता प्राप्त राजनैतिक दलोें के नेता। बहुमत किसका रहेगा ? यदि वे आजम खान को भेज दें तो उन्हें कौन रोक लेगा, कौन विरोध करेगा ? और यह जो प्राधिकरण होगा, जिसको राजनैतिक दलों के नेता चुनकर भेजेेंगे जिनके इलिजीबिलिटी काराईटेरियन्स ह्नेग हैं। जब पूरे देश में विरोध हुआ तो इस प्रावधान को बदला गया पर अभी भी प्राधिकरण के सदस्यों से सरकार के बहुमत वाला पैनल ही चुनेगा।

इस बात के बावजूद कि कानून और व्यवस्था राज्यों का विषय है, इनके पास देशभर में झगड़े की किसी भी घटना के बारे जांच करने का अधिकार होगा। अभी तसल्ली नहीं हुयी। झगड़ा न हो तो भी जांच करने का अधिकार होगा। इन्हें लगे कि सम्भावना है कि झगड़ा होगा, तो भी जांच करेंगे। ये शब्द बिल से पढ़ रहा हूँ, मेरी व्याख्याऐं नहीं हैं। मैं बार-बार इस बात पर जोर दे कर कह रहा हूँ। कि मैं केवल वही दोहरा रहा हूँ जो इस बिल में प्रस्तावित है। झगड़े की जांच करेंगे। झगड़े की अन्देशेवाली स्थितियों की जांच करेंगे। झगड़े की सम्भावना हो उसकी जांच करेंगे। देश भर में करेंगे।

अमला कौन सा होगा जांच करने का ? बिल कहता कि डायरेक्टर जनरल ऑफ पुलिस के कैडर का एक अधिकारी अपनी फोर्ष के साथ इस अथोरिटी को जांच के लिए उपलब्ध कराया जायेगा। इनके आदेश मानेगा वो। ये पूरे देश में सभी राज्यों में कहीं से भी किसी भी अफसर को समन कर सकते हैं; किसी भी फाइल को समन कर सकते हैं; किसी भी व्यक्ति को गवाही देने के लिए बुला सकते हैं। पूरे देश में कोई भी फाइल, कोई भी ऑफिसर, कोई व्यक्ति हो, ये जाकर जांच कर सकते हैं। किसी भी कैंप में किसी भी थाने में, किसी भी जेल में जाकर कर सकते हैं। अब क्या बच गया ?

आपने कभी नहीं सुना होगा कि किसी भी कोर्ट की कार्यवाही की देखभाल करने के लिए पर्यवेक्षक (ओब्जर्वर) बिठा सकते हैं। कानून में लिखा है कि आप कोट में ओब्जर्वर बिठा सकते हैं। कोर्ट की कार्यवाही से संतुष्ट न हों तो कोर्ट में कह सकते हैं कि हम इसमें पार्टी बनाना चाहते हैं। एक ऐसी संस्था जो कोर्ट से भी ऊपर हो जायेगी राज्यों को ’एडवाइजरीज‘ भेज सकते हैं। इतने विषद् अधिकार।

 मैंने प्रश्न खड़ा किया था आपके सामने, कि जब दंगे नहीं हो रहे हैं, तब यह कानून क्यों ? मैंने कहा था, उत्तर बाद दूंगा। मेरी समझ में इसका उत्तर है कि दंगेे नहीं हो रहे हैं, इसलिए यह कानून है। कुछ राजनैतिक दलों को दंगों की जरूरत है। यूपीए के घटक दलों को दंगों की जरूरत है। कुछ समुदाय के अन्दर असुरक्षा और भय का वातावरण निर्माण किया जाये, इसकी जरूरत है। उत्तर प्रदेश के चुनावों में किसी समुदाय के समूह को वोट प्राप्त करने के लिए इस बिल की जरूरत है।

एक दूसरी भी जरूरत है। तमाम षड़यंत्रों के बावजूद गुजरात की सरकार के खिलाप उन्हें कुछ भी नहीं मिला। छः राज्यों में तो भाजपा की सरकारें हैं, तीन राज्यों में वो गठबंधन सरकार में हैं। कहीं पर ए॰डी॰एम॰के॰ राज कर रही है, कहीं पर कोई दूसरी पार्टी राज कर रही है। यूपीए सरकार जब से अपने दूसरे अवतार में आई है, वह राज्यों के अधिकारों पर अतिक्रमण करने के लिए निरंतर प्रयत्न कर रही है। जब नेशनल इन्वेस्टीगेशन एजेंसी बनायी थी, वह एक प्रयत्न था राज्यों के अधिकारों को कम करने का, बीज का बिधेयक हो पानी की समस्या हो, सब में हस्तक्षेप कर रही है। आखिर राज्यों को भी अपने अधिकार संविधान से मिलते हैं। उन संवैधानिक अधिकारों पर डाका क्यों डाला जाये ? यह जो नेशनल अथोरिटी बन रही है, यह कानून और व्यवस्था के मामले में राज्यों के अधिकारों पर डाका डालने का एक सीधा और बेईमान प्रयत्न है। घटना कैसी भी हो, ना भी हो, तो यह हस्तक्षेप कर सकेगी। यह नहीं चलेगा।

और इसमें तीसरी बात जो मुझे आपत्तिजनक लगती है, वह यह कि सर्वोच्च न्यायालय लगातार दो अधिकारों की सुरक्षा कर रहा है, सार्वजनिक जीवन में सूचना के अधिकार की सुरक्षा कर रहा है, जानकारी का अधिकार, पारदर्शिता का अधिकार, सरकार के कामकाजों में अन्दर तक झांकने का अधिकार। उसी आग्रह के साथ सुप्रीम कोर्ट रक्षा कर रहा है, व्यक्तिगत जीवन में गोपनीयता का अधिकार। यदि आप सार्वजनिक जीवन में नहीं हैं, तो किसी को भी अधिकार नहीं है। कि आपके बैड-रूम में झांके। हर मनुष्य का घर उसके लिए एक किला होता है। सुप्रीम कोर्ट ने कहा उसके अन्दर झांकने की कानून को इजाजत नहीं। यह निजता का अधिकार है। पर इस कानून में हर राज्य में प्राधिकृत अधिकारी होगा, जिसको कोई भी मेल, ई-मेल, संदेश आदि यह पढ़ने देखने का अधिकार होगा।
जितनी प्रगति हुई है निजता की अधिकार की, वह खण्डित हो जायेगी। सब लोग सरकार से अपेक्षा करते थे कि ऐसा कुछ कर सकती है या सरकार ऐसा करने पर तुली हुयी थी, जिसकी आप कल्पना भी न करते हो। इसलिए वह केवल आपके संदेशों को पढ़ सके, इतना ही अधिकार उन्होंने नहीं लिया वरण् अगर उनको लगता है कि यह डाक उनको नहीं पहुंचानी चाहिए-तो वो इसको अपने पास ही रोक सकते हैं। वो तय कर सकते हैं ये चिट्ठियां रेसिपिऐंट को नहीं पहुंचाई जायेगी।

कौन-कौन से अधिकारोें पर डाका डाला जा रहा है। अभिव्यक्ति का अधिकार, मुझे यह अधिकार है कि मैं अपने अधिकार का पालन करूं, मुझे संविधान यह अधिकार भी देता कि मैं अपने धर्म का प्रचार करूं। इसमें अपने धर्म का मंडन करने और अन्य धर्मों की आलोचना का अधिकार देता है। यह बिल प्रचार और अभिव्यक्ति की स्वतंत्रता पर रोक लगाता है।

यह एसोसिएशन्स पर और नौकरशाहों पर दबाव डालता है कि ’बिल्डअप‘ को भी रोकना है इसलिए ऐसी सब चीजों पर अतिरिक्त सावधान रह कर, यदि तुम्हें गलती भी करनी तो बहुसंख्यकों के खिलाप करो, कार्यवाही करो।

मैं अभी एक इन्टरव्यू पढ़ रहा था, अभिषेक मनु सिंघवी का। कांग्रेस के प्रवक्ता हैं, इसलिए मैं यह मान लूंगा कि यह जो वक्तव्य है, यह कांग्रेस के समर्थन से है। उनसे पूछा गया कि यह कानून क्यों बना रहे हैं ? उन्होंने कहा कि भाई! अल्पसंख्यकों की रक्षा की जरूरत है उनमें विश्वास जगाने की जरूरत है। इसलिए हम रिलीजियस माइनारिटीस के लिए बना रहे हैं।

पर भई दंगे जो होते वे हमेशा बहुमत शुरू करे ऐसा नहीं होता। कभी-कभी अल्पसंख्यक भी शुरू करते होंगे। सन 2005-06 में एक डेनिश-अखवार में कुछ कार्टून छप गये। उनका भारत या भारत के बहुसंख्य समाज से कोई संबंध नहीं है। डेनिश अखवार के उस कार्टून के ऊपर देश में दंगे होते हैं। बहुसंख्य समाज के लोगों के घर और वाहन जला दिये जाते हैं। उसमें तो बहुसंख्य समाज की कोई गलती ही नहीं होती।

कुछ साल पहले दक्षिण में कोई एक कहानी लिखी गयी जिसका एक पात्र मोहम्मद था। मोहम्मद को तुमने पात्र कैसे बनाया, इस बात को लेकर वहां दंगे भड़क जाते हैं, लेखक तो मिलता नहीं है, उस शहर में रहने वाले बहुसंख्य समाज के लोगों घर-मकान जला दिये जाते हैं। केरल में हजरत मोहम्मद के बारे परीक्षा में एक प्रश्न आया तो प्रश्न पत्र बनाने वाले का एक हाथ काट दिया गया।

डा॰ सिंघवी से पूछा गया कि भाई! ये जो आपने इतने प्रावधान बनाये हैं, दंगा करने वालों पर बराबरी से लागू क्यों नहीं करते हो। अल्पसंख्यक समाज के लोगों पर भी लागू क्यों नहीं करते हो। उनका छपा हुआ जबाव है, अगर अल्पसंख्यक समुदाय हिंसा करता है तो “इस तरह के दंगों और स्थितियों से निपटने के लिए हमारी आई॰पी॰सी॰ में पर्याप्त कड़े प्रावधान हैं।”

आपको ध्यान होगा, जब यू॰पी॰ए॰ आई थी तब टाडा हटाया था। तर्क क्या था, हमारे कानून में आंतकियों से निबटने के लिए पर्याप्त प्रावधान है। हमको विशेष कानून नहीं चाहिए। अगर आंतकियों से निबटने के लिए पर्याप्त प्रावधान हैं; जिहादियों से निबटने के लिए पर्याप्त प्रावधान है; नक्सलवादियों से निबटने के लिए पर्याप्त प्रावधान है; अल्पसंख्यक हिंसा करें तो निपटने के लिए वर्तमान कानून में सख्त प्रावधान हैं; तो क्या इस देश का बहुसंख्य समाज अपने ही देश में इतना खतरनाक है कि जो प्रावधान आपको टेरिरिस्टों के लिए, इन्सर्जेटस के लिए, नक्सलीज के लिए जिहादी के लिए नहीं चाहिए, वह देश के बहुसंख्य समाज के लिए चाहिए। क्या यह तर्क की चरम विकृत नहीं है ?

गोधरा के अंदर जिन्होंने कार-सेवकों को बंद कर करके जला दिया उन पर यह कानून लागू नहीं होगा। इसकी प्रतिक्रिया में जो गुजरात में दंगे हुये, उसमें केवल बहुसंख्य समाज के लोगों पर यह कानून लागू हुआ। क्या यह समता के अधिकार का उलंघन नहीं है ?

किसने बनाया यह कानून ? आजकल लोकपाल बिल पर झगड़ा चल रहा है। आरोप क्या लगाया जा रहा है। प्रणव दा ने भी कहा है, (मैंने यह नाम इसलिए लिया क्योंकि दिग्विजय सिंह का नाम होता तो कोई गंभीरता से नहीं लेता) उन्होंने कहा ’अन-इलेक्टेड एण्ड अनइलेक्टेबल‘ लोग हमको कानून बता रहे हैं। चुनाव लड़ा नहीं चुनाव जीत नहीं सकते, वो कानून बता रहे हैं। मेरे मन में आया कि मैं उनसे पूछूं कि प्रधानमंत्री जी भी कोई चुनाव नहीं जीते आज तक। मैं ऐसा नहीं चाहता कि इस विषय का राजनीतिकरण लोगों को लगे, हालांकि विषय राजनीति का है तो अनइलेक्टेड-अनइलेक्टेबल लोग सिविल सोसायटी के नाम पर पार्लियामेंट की शक्तियों को परे करके सत्यागृह के बल से हम पर कानून लाद रहे हैं, यह संविधान का और संसद का अपमान है। यह वह बुद्धिमत्तापूर्ण तर्क है जो अण्णा हजारे के खिलाप हम एक हफ्ते से सुन रहे हैं। इस छंजपदंस ।कअपेवतल ब्वनदबपस सोनिया जी को छोड़कर कोई भी चुना हुआ सदस्य नहीं है। चेयरमैन को छोड़ लगभग सब लोग वो हैं, जिन्होंने कुछ न कुछ एन॰जी॰ओ॰ बनाई हैं और दुनिया भर से पैसा इकट्ठा करते हैं। इसमें वो लोग हैं जिनके खिलाप शिकायत है कि इन्होंने गुजरात के संकट में गवाहों को पैसा देकर, चैक से पैसा देकर, खरीदकर शपथपत्र दिलवाये थे, झूठ शपथपत्र। अगर आपको एन॰जी॰ओ॰ की लिस्ट चाहिए, तो गुजरात के मामले पर वहां कौन-कौन सक्रिय रहे इसकी सूची देख लीजिये, दोनों लगभग एक ही सूची हैं। सरकार के खर्चे से, सरकार के प्रशासनिक आदेश से, झोला-छाप लोगों का एक समूह मिल करके विश्वसनीयत संदिग्ध हैं, ऐसे लोग फराह नक्वी, हर्ष मंदर, तीस्ता सितलवाड़, सैयद साहबुद्दीन जैसे।

कानून पर चर्चा तो एक बात है, पर इस तरह के कानून लोगों की कल्पना में क्यों आ जाते हैं ? कैसे उनको साहस हो जाता है कि उसको सार्वजनिक करें। कैसे यह हो जाता है कि वे इसकी वकालत करें। मैं सोच रहा स्वाधीनता हमें प्राप्त हुई यह सच है, हम अपने ही अधीन हैं, अंग्रेजों के नहीं। स्वराज आया यह सच है, हम राज कर रहे हैं विदेशी नहीं। पर स्वतंत्रता आई कि नहीं इस पर जरूर शक है। ये तंत्र हमारा है कि नहीं इस शक है।

भारतीय परम्परा, भारतीय संस्कृति, भारतीय सरकारों के आधार पर इस देश की राष्ट्रात्मा के तथा इस देश की चिति के अनुकूल यहां का विराट् खड़ा ह ुआ कि नहीं ? फिर यह हुआ कि विदेशों से जो व्यवस्था आई थी, जो प्रावधान 1935 के गर्वनमेंट आफ इन्डिया एक्ट द्वारा लागू किये गये थे, उन्हीं को छोटे-मोटे संशोधनों के द्वारा हमने संविधान मान लिया और संविधान में उसी ढंग का लोकतंत्र उसी ढंग की न्याय-व्यवस्था, उसी ढंग की शिक्षा व्यवस्था, सारा वह आयातित तंत्र जो हमारे ऊपर आरोपित होता है, इसको चलाने का हम प्रयत्न करते हैं। इससे हमारे अन्दर का ’स्व‘ और ’विराट‘ जागृृत नहीं होता। उस ’स्व‘ और ’विराट‘ के कुन्ठित हो जाने का परिणाम यह है कि इस तरह का कानून बनाने की प्रस्तावना होती है। इस तरह का कानून लागू होता है और एक बड़ी जमात खड़ी हो जाती है, जो कहती है कि हां! इस देश के हिन्दू, ये वास्तव में आक्रामक हैं। इस देश की पुलिस यह वास्तव में असभ्य है। इस देश की सेना यह जंगली है। इस देश की नौकरशाही, यह बार्बरिक है। इन सबसे इस देश के अल्पसंख्यकों की रक्षा करनी चाहिए। इस तरह की बातों कोे अगर ठीक करना होगा, तो केवल बिल के खिलाप संघर्ष करने से नहीं होगा, इस राष्ट्र की चिति जगे, इस राष्ट्र का विराट् जगे। ऐसे किसी महा-अभियान के द्वारा इन चीजों का मुकाबला करके, हम इस देश को इसके योग्य स्थान पर ले जा सकेंगे, मुझे लगता है कि 15 अगस्त के दिन इतना कहना पर्याप्त होगा। बहुत-बहुत धन्यवाद।
